Terms Of Service - TNTPowerHost:

Section 1 - Acceptable Use:

By using this service, customer agrees to all the policies set forth in our Acceptable Use Policy.

Section 2 - Content

Customers are solely responsible for content on their accounts and TNTPowerHost cannot be held responsible for any content on websites hosted on our servers. Accounts with illegal content will be subject to suspension.

Section 3 - Uptime Guarantee/SLA (Service Level Agreement)

TNTPowerHost offers a 99.9% uptime guarantee to all hosting customers. In the event of an outage lasting longer than 0.1% of the month, the customer may request an SLA credit from the billing department. The customer will receive a 5% credit for every 15 minutes that their service is unavailable beyond the 0.1% monthly limit. The total amount credited shall not exceed the purchase price (100%). SLA credits do not apply to scheduled maintenance, which will always be announced in advance.

Downtime is defined as the TNTPowerHost service being unavailable due to a problem on our end such as a hardware issue, or an issue with our network that causes complete downtime or causes the service to be unusable. Downtime is measured by multiple offsite monitoring solutions. SLA credits cannot be issued for issues out of our control such as a customer's Internet Service Provider having problems or a customer misconfiguration.

Section 4 - Suspension, Cancellation, and Termination

TNTPowerHost can suspend customer's account at any time for violation of our Acceptable Use Policy, but not without sending notification via email, phone, or fax. Suspension means the website will not be available to visitors, however data will remain intact.

Customers are responsible for keeping their PHP and CGI scripts up to date. Accounts that have been compromised due to outdated scripts will be dealt with on an individual basis. Possible actions for compromised accounts that are sending out spam, Denial of Service attacks, or performing other malicious actions include but are not limited to: killing the offending processes, suspending the account until the account owner can be contacted. TNTPowerHost reserves the right to remove malicious scripts if necessary to protect the integrity of our service and to stop any hacked processes from running.

In the event of a customer canceling service, TNTPowerHost will retain customer's data for a maximum of 10 days beyond the cancellation date. Customer must cancel the plan and inform TNTPowerHost of the intended cancellation before midnight (00:00:00) on the renewal date to avoid automatically being charged for another month.

Section 5 - Billing

TNTPowerHost services are billed in an "anniversary" billing mode. This means customers will be billed on the same day every month. We strongly encourage customers to start a PayPal recurring subscription for their hosting upon checkout so payments are made automatically every month. This will help reduce billing confusion.

To avoid any service interruptions, customers should make sure all invoices are paid within 10 days of the due date. If an invoice is not paid within 10 days of the due date and no special arrangements have been made, TNTPowerHost will suspend the customer's account until past due invoices are paid. We will always make several contact attempts to contact the account holder before the 10 day limit is up and before suspension occurs.

Section 6 - Overages

The customer will receive notices from our system regarding bandwidth and disk space usage. If a customer's bandwidth limit is exceeded, our system will automatically suspend the account. To avoid suspension due to exceeding resource limits, we encourage customers to monitor the email address registered with us for these notices and upgrade their plan before running out of resources.

Section 7 - Liability

TNTPowerHost cannot make any guarantees or be held liable regarding customer data. All accounts are fully backed up every night so data can be easily restored in the event of a hard drive failure. However, we encourage customers to keep offsite backups of their important data such as databases and emails as a precautionary measure in case there are any unforeseen complications in restoring data.
